项目审批制度改革的实施意(yi)见

各省、自治区(qu)、直辖(xia)市人(ren)民政府,国(guo)务院各部委(wei)、各直属(shu)机(ji)构:
工(gong)程(cheng)建(jian)设(she)项目(mu)(mu)审(shen)(shen)批制(zhi)度(du)(du)改(gai)革(ge)是(shi)党中央、国(guo)务院(yuan)(yuan)在(zai)新形势下作出的重大决策,是(shi)推进政府(fu)职能转(zhuan)变和(he)深化“放管服”改(gai)革(ge)、优化营(ying)商环(huan)境(jing)的重要内(nei)容。2018年5月工(gong)程(cheng)建(jian)设(she)项目(mu)(mu)审(shen)(shen)批制(zhi)度(du)(du)改(gai)革(ge)试点开展(zhan)以来,试点地区(qu)按照(zhao)国(guo)务院(yuan)(yuan)部(bu)署,对(dui)工(gong)程(cheng)建(jian)设(she)项目(mu)(mu)审(shen)(shen)批制(zhi)度(du)(du)实施了全流程(cheng)、全覆盖改(gai)革(ge),基本形成统(tong)一(yi)的审(shen)(shen)批流程(cheng)、统(tong)一(yi)的信息数(shu)据平台、统(tong)一(yi)的审(shen)(shen)批管理体系和(he)统(tong)一(yi)的监管方式。经国(guo)务院(yuan)(yuan)同(tong)意,现就全面(mian)开展(zhan)工(gong)程(cheng)建(jian)设(she)项目(mu)(mu)审(shen)(shen)批制(zhi)度(du)(du)改(gai)革(ge)提(ti)出以下意见。
一、总体要(yao)求(qiu)
(一)指导思想。以(yi)(yi)习近平新(xin)时代中(zhong)国特色社会主义思想为(wei)(wei)指(zhi)导,深入(ru)贯彻党(dang)的十九(jiu)大和十九(jiu)届二(er)中(zhong)、三中(zhong)全(quan)会精(jing)神,坚持以(yi)(yi)人民为(wei)(wei)中(zhong)心,牢固树立(li)新(xin)发展理(li)念(nian),以(yi)(yi)推进政(zheng)府治(zhi)理(li)体系和治(zhi)理(li)能(neng)力(li)现代化为(wei)(wei)目(mu)(mu)标,以(yi)(yi)更好更快方便(bian)企(qi)业和群众(zhong)办事为(wei)(wei)导向(xiang),加大转变政(zheng)府职能(neng)和简政(zheng)放权力(li)度,全(quan)面开展工程建(jian)设项(xiang)目(mu)(mu)审(shen)(shen)批制度改革(ge),统一审(shen)(shen)批流(liu)程,统一信息数据(ju)平台,统一审(shen)(shen)批管(guan)理(li)体系,统一监管(guan)方式,实现工程建(jian)设项(xiang)目(mu)(mu)审(shen)(shen)批“四(si)统一”。
(二)改革内容。对(dui)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建设项目审(shen)批制(zhi)度实施全流程(cheng)(cheng)(cheng)、全覆盖(gai)改革(ge)(ge)。改革(ge)(ge)覆盖(gai)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建设项目审(shen)批全过(guo)程(cheng)(cheng)(cheng)(包括从(cong)立项到竣工(gong)(gong)(gong)验收和公(gong)共设施接入服(fu)务);主(zhu)要是房屋建筑和城市基础设施等工(gong)(gong)(gong)程(cheng)(cheng)(cheng),不包括特殊工(gong)(gong)(gong)程(cheng)(cheng)(cheng)和交通、水利、能(neng)源(yuan)等领域的重大工(gong)(gong)(gong)程(cheng)(cheng)(cheng);覆盖(gai)行政许可等审(shen)批事项和技术(shu)审(shen)查、中介(jie)服(fu)务、市政公(gong)用服(fu)务以及备案等其他类(lei)型事项,推动流程(cheng)(cheng)(cheng)优(you)化(hua)和标准化(hua)。
(三)主要目标。2019年上(shang)半(ban)年,全(quan)国(guo)(guo)工(gong)(gong)程建(jian)设(she)项目(mu)(mu)审批(pi)(pi)时间压缩(suo)至120个工(gong)(gong)作日以(yi)内,省(自(zi)治区(qu))和地级及以(yi)上(shang)城市(shi)初(chu)步建(jian)成(cheng)(cheng)工(gong)(gong)程建(jian)设(she)项目(mu)(mu)审批(pi)(pi)制度框架和信息数据平台(tai);到2019年底,工(gong)(gong)程建(jian)设(she)项目(mu)(mu)审批(pi)(pi)管(guan)理(li)系(xi)统与相关系(xi)统平台(tai)互(hu)(hu)联互(hu)(hu)通(tong);试点地区(qu)继(ji)续深(shen)化改革,加大改革创新力(li)度,进一步精简审批(pi)(pi)环(huan)节和事项,减少审批(pi)(pi)阶段,压减审批(pi)(pi)时间,加强辅导(dao)服务,提高审批(pi)(pi)效能。到2020年底,基本建(jian)成(cheng)(cheng)全(quan)国(guo)(guo)统一的工(gong)(gong)程建(jian)设(she)项目(mu)(mu)审批(pi)(pi)和管(guan)理(li)体(ti)系(xi)。
二、统一审批流程
(四)精简审批环节。精(jing)减(jian)审(shen)(shen)批(pi)事(shi)项(xiang)(xiang)和条件(jian),取(qu)消(xiao)不(bu)合法、不(bu)合理(li)、不(bu)必(bi)要的审(shen)(shen)批(pi)事(shi)项(xiang)(xiang),减(jian)少(shao)保留事(shi)项(xiang)(xiang)的前(qian)(qian)(qian)(qian)置条件(jian)。下(xia)(xia)放审(shen)(shen)批(pi)权限(xian),按照方(fang)(fang)便企业和群众办事(shi)的原则,对下(xia)(xia)级(ji)机关有能力承(cheng)接的审(shen)(shen)批(pi)事(shi)项(xiang)(xiang),下(xia)(xia)放或委托下(xia)(xia)级(ji)机关审(shen)(shen)批(pi)。合并(bing)审(shen)(shen)批(pi)事(shi)项(xiang)(xiang),对由同(tong)(tong)一部(bu)(bu)门实施(shi)的管理(li)内容(rong)相近或者属于同(tong)(tong)一办理(li)阶段的多(duo)个审(shen)(shen)批(pi)事(shi)项(xiang)(xiang),整(zheng)合为一个审(shen)(shen)批(pi)事(shi)项(xiang)(xiang)。转(zhuan)变管理(li)方(fang)(fang)式,对能够用征求相关部(bu)(bu)门意(yi)见(jian)方(fang)(fang)式替代的审(shen)(shen)批(pi)事(shi)项(xiang)(xiang),调整(zheng)为政(zheng)府(fu)内部(bu)(bu)协作事(shi)项(xiang)(xiang)。调整(zheng)审(shen)(shen)批(pi)时序(xu),地震安全性评(ping)(ping)价在(zai)工(gong)(gong)(gong)程(cheng)设计(ji)(ji)前(qian)(qian)(qian)(qian)完成(cheng)(cheng)即可(ke)(ke),环境影响评(ping)(ping)价、节(jie)能评(ping)(ping)价等评(ping)(ping)估评(ping)(ping)价和取(qu)水(shui)许可(ke)(ke)等事(shi)项(xiang)(xiang)在(zai)开工(gong)(gong)(gong)前(qian)(qian)(qian)(qian)完成(cheng)(cheng)即可(ke)(ke);可(ke)(ke)以将用地预(yu)审(shen)(shen)意(yi)见(jian)作为使用土地证(zheng)明文件(jian)申请办理(li)建(jian)设工(gong)(gong)(gong)程(cheng)规划许可(ke)(ke)证(zheng);将供水(shui)、供电、燃气、热(re)力、排水(shui)、通(tong)信等市政(zheng)公用基础设施(shi)报装提(ti)前(qian)(qian)(qian)(qian)到开工(gong)(gong)(gong)前(qian)(qian)(qian)(qian)办理(li),在(zai)工(gong)(gong)(gong)程(cheng)施(shi)工(gong)(gong)(gong)阶段完成(cheng)(cheng)相关设施(shi)建(jian)设,竣工(gong)(gong)(gong)验(yan)收后直接办理(li)接入事(shi)宜(yi)。试点地区要进一步精(jing)简(jian)审(shen)(shen)批(pi)环节(jie),在(zai)加(jia)快探索取(qu)消(xiao)施(shi)工(gong)(gong)(gong)图审(shen)(shen)查(或缩小审(shen)(shen)查范围)、实行(xing)告知承(cheng)诺制(zhi)(zhi)和设计(ji)(ji)人员终身负责制(zhi)(zhi)等方(fang)(fang)面,尽快形成(cheng)(cheng)可(ke)(ke)复(fu)制(zhi)(zhi)可(ke)(ke)推广的经验(yan)。
(五)规范审批事项。各地(di)要按照国(guo)(guo)务院统(tong)一(yi)要求,对本地(di)区工(gong)程建设(she)项(xiang)(xiang)目审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)进行全面(mian)清(qing)理(li),统(tong)一(yi)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)和法律依据,逐步形(xing)成全国(guo)(guo)统(tong)一(yi)的(de)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)名(ming)称、申请材料和审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)时限(xian)。要本着(zhe)合法、精简、效能的(de)原则,制(zhi)定国(guo)(guo)家、省(自(zi)治(zhi)区)和地(di)级(ji)(ji)及以上城市工(gong)程建设(she)项(xiang)(xiang)目审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)清(qing)单(dan)(dan),明确各项(xiang)(xiang)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)的(de)适用范(fan)围和前置条件,并(bing)实(shi)行动态(tai)管理(li)。下级(ji)(ji)政(zheng)府(fu)制(zhi)定的(de)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)清(qing)单(dan)(dan)原则上要与上级(ji)(ji)政(zheng)府(fu)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)清(qing)单(dan)(dan)一(yi)致,超出(chu)上级(ji)(ji)政(zheng)府(fu)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)项(xiang)(xiang)清(qing)单(dan)(dan)范(fan)围的(de),要报上级(ji)(ji)机关备(bei)案,并(bing)说(shuo)明理(li)由(you)。
(六)合理划分审批阶段。将工(gong)程(cheng)建设项(xiang)(xiang)目审(shen)批(pi)(pi)流程(cheng)主(zhu)(zhu)要(yao)(yao)划(hua)分(fen)为(wei)立项(xiang)(xiang)用(yong)(yong)地规(gui)(gui)划(hua)许(xu)可(ke)、工(gong)程(cheng)建设许(xu)可(ke)、施(shi)工(gong)许(xu)可(ke)、竣工(gong)验(yan)收(shou)四个(ge)阶段(duan)。其(qi)中(zhong),立项(xiang)(xiang)用(yong)(yong)地规(gui)(gui)划(hua)许(xu)可(ke)阶段(duan)主(zhu)(zhu)要(yao)(yao)包(bao)括项(xiang)(xiang)目审(shen)批(pi)(pi)核(he)准、选址意(yi)见书核(he)发(fa)、用(yong)(yong)地预审(shen)、用(yong)(yong)地规(gui)(gui)划(hua)许(xu)可(ke)证核(he)发(fa)等(deng)。工(gong)程(cheng)建设许(xu)可(ke)阶段(duan)主(zhu)(zhu)要(yao)(yao)包(bao)括设计方案(an)审(shen)查(cha)、建设工(gong)程(cheng)规(gui)(gui)划(hua)许(xu)可(ke)证核(he)发(fa)等(deng)。施(shi)工(gong)许(xu)可(ke)阶段(duan)主(zhu)(zhu)要(yao)(yao)包(bao)括设计审(shen)核(he)确认(ren)、施(shi)工(gong)许(xu)可(ke)证核(he)发(fa)等(deng)。竣工(gong)验(yan)收(shou)阶段(duan)主(zhu)(zhu)要(yao)(yao)包(bao)括规(gui)(gui)划(hua)、土地、消防(fang)、人防(fang)、档案(an)等(deng)验(yan)收(shou)及竣工(gong)验(yan)收(shou)备案(an)等(deng)。其(qi)他行(xing)(xing)政许(xu)可(ke)、强制性评估、中(zhong)介服务(wu)、市(shi)政公用(yong)(yong)服务(wu)以(yi)及备案(an)等(deng)事项(xiang)(xiang)纳入相关阶段(duan)办理或(huo)与相关阶段(duan)并行(xing)(xing)推(tui)进。每个(ge)审(shen)批(pi)(pi)阶段(duan)确定一家牵(qian)头部门,实行(xing)(xing)“一家牵(qian)头、并联(lian)审(shen)批(pi)(pi)、限时办结(jie)”,由牵(qian)头部门组(zu)织协调相关部门严格按照限定时间完成审(shen)批(pi)(pi)。
(七)分类制定审批流程。制定(ding)全国统一(yi)的(de)工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)项(xiang)目(mu)审批(pi)流程(cheng)(cheng)(cheng)图示(shi)范文本。地级及以上地方(fang)人民(min)政府要(yao)根据示(shi)范文本,分别制定(ding)政府投资、社会(hui)投资等不(bu)同类(lei)型(xing)工程(cheng)(cheng)(cheng)的(de)审批(pi)流程(cheng)(cheng)(cheng)图;同时可(ke)(ke)(ke)结合实际,根据工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)项(xiang)目(mu)类(lei)型(xing)、投资类(lei)别、规模大小等,进一(yi)步梳理合并(bing)审批(pi)流程(cheng)(cheng)(cheng)。简化(hua)社会(hui)投资的(de)中小型(xing)工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)项(xiang)目(mu)审批(pi),对于带方(fang)案出让土(tu)地的(de)项(xiang)目(mu),不(bu)再对设(she)计方(fang)案进行审核(he),将工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)许(xu)可(ke)(ke)(ke)和施工许(xu)可(ke)(ke)(ke)合并(bing)为一(yi)个阶段(duan)。试点地区要(yao)进一(yi)步加大改革力度,也(ye)可(ke)(ke)(ke)以在其他工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)项(xiang)目(mu)中探索(suo)将工程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)设(she)许(xu)可(ke)(ke)(ke)和施工许(xu)可(ke)(ke)(ke)合并(bing)为一(yi)个阶段(duan)。
(八)实行联合审图和联合验收。制定(ding)施(shi)工图设计文(wen)件(jian)联(lian)合(he)(he)审查(cha)和联(lian)合(he)(he)竣工验(yan)收(shou)管(guan)理(li)办法。将消(xiao)防(fang)、人防(fang)、技防(fang)等技术审查(cha)并入施(shi)工图设计文(wen)件(jian)审查(cha),相关部(bu)门不再进行(xing)技术审查(cha)。实行(xing)规划、土地、消(xiao)防(fang)、人防(fang)、档案等事项限(xian)时联(lian)合(he)(he)验(yan)收(shou),统一竣工验(yan)收(shou)图纸和验(yan)收(shou)标准,统一出(chu)具验(yan)收(shou)意见。对于验(yan)收(shou)涉及的测绘工作,实行(xing)“一次委托、联(lian)合(he)(he)测绘、成果(guo)共(gong)享(xiang)”。
(九)推行区域评估。在各类开发(fa)区(qu)、工(gong)业园区(qu)、新区(qu)和其他(ta)有条件的区(qu)域,推行由政府统一组织对压(ya)覆重要矿产资源(yuan)、环境(jing)影响评价、节能评价、地质灾害危险性评估(gu)、地震安全性评价、水资源(yuan)论证等评估(gu)评价事项实行区(qu)域评估(gu)。实行区(qu)域评估(gu)的,政府相关部门(men)应在土地出让(rang)或(huo)划拨前,告(gao)知建(jian)(jian)设单位相关建(jian)(jian)设要求(qiu)。
(十)推行告知承诺制。对通(tong)过事(shi)中事(shi)后(hou)监(jian)管(guan)能够纠正不符合审批条(tiao)件的(de)(de)行为且不会产生严重后(hou)果的(de)(de)审批事(shi)项(xiang)(xiang),实(shi)行告知承(cheng)(cheng)诺(nuo)制。公布实(shi)行告知承(cheng)(cheng)诺(nuo)制的(de)(de)工程建设项(xiang)(xiang)目(mu)(mu)审批事(shi)项(xiang)(xiang)清(qing)单及具体要求,申(shen)请人(ren)按照要求作出书(shu)面承(cheng)(cheng)诺(nuo)的(de)(de),审批部门可以根据申(shen)请人(ren)信用(yong)等(deng)情况直接作出审批决定。对已经(jing)实(shi)施区域评估范围(wei)内(nei)的(de)(de)工程建设项(xiang)(xiang)目(mu)(mu),相应(ying)的(de)(de)审批事(shi)项(xiang)(xiang)实(shi)行告知承(cheng)(cheng)诺(nuo)制。
三、统一信息数(shu)据平台

四、统一审批管理体系
(十二)“一张蓝图”统筹项目实施。统筹整合(he)各类规划(hua),划(hua)定(ding)各类控制(zhi)线,构(gou)建(jian)(jian)(jian)“多规合(he)一(yi)(yi)”的(de)“一(yi)(yi)张(zhang)蓝图(tu)”。依托工(gong)程(cheng)建(jian)(jian)(jian)设(she)项(xiang)目(mu)(mu)(mu)审(shen)批(pi)(pi)管(guan)(guan)理系统,加强(qiang)“多规合(he)一(yi)(yi)”业务协(xie)同,统筹协(xie)调各部门对工(gong)程(cheng)建(jian)(jian)(jian)设(she)项(xiang)目(mu)(mu)(mu)提(ti)出(chu)建(jian)(jian)(jian)设(she)条(tiao)件(jian)(jian)以及需(xu)要(yao)(yao)开展(zhan)的(de)评估评价事项(xiang)等要(yao)(yao)求(qiu),为(wei)项(xiang)目(mu)(mu)(mu)建(jian)(jian)(jian)设(she)单(dan)位落实建(jian)(jian)(jian)设(she)条(tiao)件(jian)(jian)、相(xiang)关部门加强(qiang)监督管(guan)(guan)理提(ti)供依据,加速(su)项(xiang)目(mu)(mu)(mu)前期(qi)策划(hua)生(sheng)成,简化项(xiang)目(mu)(mu)(mu)审(shen)批(pi)(pi)或核准手续(xu)。
(十三)“一个窗口”提供综合服务。县级及以上城市(shi)人(ren)(ren)民(min)(min)政(zheng)府(fu)要加强政(zheng)务(wu)(wu)大厅建设(she),发(fa)挥服(fu)(fu)务(wu)(wu)企业(ye)群众、监(jian)督协调审(shen)批的(de)作用。整合(he)(he)各部门(men)和(he)各市(shi)政(zheng)公用单位分散设(she)立的(de)服(fu)(fu)务(wu)(wu)窗(chuang)(chuang)口(kou),设(she)立工程(cheng)(cheng)建设(she)项(xiang)目审(shen)批综合(he)(he)服(fu)(fu)务(wu)(wu)窗(chuang)(chuang)口(kou)。建立完善(shan)“前台受理、后台审(shen)核”机制(zhi),综合(he)(he)服(fu)(fu)务(wu)(wu)窗(chuang)(chuang)口(kou)统(tong)一收件、出件,实(shi)现“一个(ge)窗(chuang)(chuang)口(kou)”服(fu)(fu)务(wu)(wu)和(he)管理。省级人(ren)(ren)民(min)(min)政(zheng)府(fu)要统(tong)一制(zhi)定本地区(qu)“一窗(chuang)(chuang)受理”的(de)工作规程(cheng)(cheng)。鼓励为申(shen)(shen)请(qing)人(ren)(ren)提(ti)供工程(cheng)(cheng)建设(she)项(xiang)目审(shen)批咨询、指导(dao)、协调和(he)代办等服(fu)(fu)务(wu)(wu),帮助企业(ye)了(le)解审(shen)批要求,提(ti)供相关工程(cheng)(cheng)建设(she)项(xiang)目的(de)申(shen)(shen)请(qing)材料清单,提(ti)高(gao)申(shen)(shen)报通过率(lv)。
(十四)“一张表单”整合申报材料。各审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)阶段均实行“一(yi)(yi)份办事(shi)指(zhi)南,一(yi)(yi)张(zhang)申(shen)(shen)请(qing)表单(dan),一(yi)(yi)套(tao)申(shen)(shen)报材(cai)料(liao),完(wan)成多(duo)项(xiang)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)”的(de)运作模式,牵(qian)头部门(men)制(zhi)定统一(yi)(yi)的(de)办事(shi)指(zhi)南和(he)申(shen)(shen)报表格,每个审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)阶段申(shen)(shen)请(qing)人只需提(ti)交(jiao)一(yi)(yi)套(tao)申(shen)(shen)报材(cai)料(liao)。建立完(wan)善审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)清(qing)单(dan)服务机制(zhi),主动(dong)为申(shen)(shen)请(qing)人提(ti)供项(xiang)目(mu)需要审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)的(de)事(shi)项(xiang)清(qing)单(dan)。不同审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)阶段的(de)审(shen)(shen)(shen)(shen)批(pi)(pi)(pi)部门(men)应当(dang)共(gong)享申(shen)(shen)报材(cai)料(liao),不得(de)要求(qiu)申(shen)(shen)请(qing)人重(zhong)复提(ti)交(jiao)。
(十五)“一套机制”规范审批运行。建(jian)(jian)(jian)立(li)健全(quan)工程建(jian)(jian)(jian)设(she)项目审(shen)批(pi)(pi)配套制度,明(ming)确部(bu)门职责(ze),明(ming)晰工作规程,规范审(shen)批(pi)(pi)行为(wei),确保(bao)审(shen)批(pi)(pi)各阶段、各环(huan)节无缝衔接。建(jian)(jian)(jian)立(li)审(shen)批(pi)(pi)协调机(ji)制,协调解决部(bu)门意见分(fen)歧。建(jian)(jian)(jian)立(li)跟踪督(du)办(ban)制度,实(shi)时跟踪审(shen)批(pi)(pi)办(ban)理情况,对(dui)全(quan)过程实(shi)施(shi)督(du)办(ban)。各级政府部(bu)门要(yao)主动加强与(yu)人大及司(si)法机(ji)构的(de)沟通协调配合(he),加快法律法规、规范性文件(jian)和标准规范的(de)立(li)改(gai)废释工作,修改(gai)或废止(zhi)与(yu)工程建(jian)(jian)(jian)设(she)项目审(shen)批(pi)(pi)制度改(gai)革(ge)(ge)要(yao)求不相符的(de)相关(guan)制度,建(jian)(jian)(jian)立(li)依法推进改(gai)革(ge)(ge)的(de)长效机(ji)制。
五、统一监管(guan)方式(shi)
(十六)加强事中事后监管。进一(yi)步转变监(jian)(jian)管(guan)理念,完善(shan)事中事后(hou)监(jian)(jian)管(guan)体系,统一(yi)规范(fan)事中事后(hou)监(jian)(jian)管(guan)模式,建立以(yi)“双随机、一(yi)公开”监(jian)(jian)管(guan)为基本手段,以(yi)重(zhong)点监(jian)(jian)管(guan)为补充,以(yi)信用监(jian)(jian)管(guan)为基础的新型(xing)监(jian)(jian)管(guan)机制,严肃查处违法违规行为。对于(yu)实行告知承(cheng)诺(nuo)(nuo)制的审批(pi)事项(xiang),审批(pi)部(bu)门(men)应当在(zai)规定时间内对承(cheng)诺(nuo)(nuo)人履行承(cheng)诺(nuo)(nuo)的情况进行检查,承(cheng)诺(nuo)(nuo)人未履行承(cheng)诺(nuo)(nuo)的,审批(pi)部(bu)门(men)要依(yi)法撤销行政审批(pi)决定并(bing)追(zhui)究承(cheng)诺(nuo)(nuo)人的相应责任(ren)。
(十七)加强信用体系建设。建立工(gong)程建设(she)项目(mu)审批(pi)信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)平(ping)台(tai),完善申请人信(xin)(xin)(xin)(xin)用(yong)记录,建立红(hong)黑名(ming)单(dan)制度,实行(xing)信(xin)(xin)(xin)(xin)用(yong)分级分类管(guan)(guan)理(li),出台(tai)工(gong)程建设(she)项目(mu)审批(pi)守信(xin)(xin)(xin)(xin)联(lian)合激(ji)励和失(shi)(shi)信(xin)(xin)(xin)(xin)联(lian)合惩(cheng)戒合作备忘(wang)录,对失(shi)(shi)信(xin)(xin)(xin)(xin)企业和从(cong)业人员(yuan)进行(xing)严格监(jian)管(guan)(guan)。将企业和从(cong)业人员(yuan)违(wei)法违(wei)规(gui)、不履(lv)行(xing)承诺(nuo)的失(shi)(shi)信(xin)(xin)(xin)(xin)行(xing)为纳入工(gong)程建设(she)项目(mu)审批(pi)管(guan)(guan)理(li)系统(tong),并与(yu)全国信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)共(gong)享(xiang)平(ping)台(tai)互(hu)联(lian)互(hu)通,加强信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)共(gong)享(xiang),构建“一处(chu)失(shi)(shi)信(xin)(xin)(xin)(xin)、处(chu)处(chu)受限”的联(lian)合惩(cheng)戒机制。
(十八)规范中介和市政公用服务。建(jian)立健全(quan)(quan)中介服(fu)(fu)务(wu)(wu)和市政(zheng)(zheng)公(gong)用服(fu)(fu)务(wu)(wu)管(guan)理(li)制度,实(shi)行服(fu)(fu)务(wu)(wu)承(cheng)诺制,明确服(fu)(fu)务(wu)(wu)标准(zhun)和办事流(liu)程,规范服(fu)(fu)务(wu)(wu)收费。依托工程建(jian)设项目审批管(guan)理(li)系(xi)统(tong)建(jian)立中介服(fu)(fu)务(wu)(wu)网上交易(yi)平台(tai),对中介服(fu)(fu)务(wu)(wu)行为实(shi)施全(quan)(quan)过程监管(guan)。供水(shui)、供电、燃(ran)气(qi)、热力、排水(shui)、通信等市政(zheng)(zheng)公(gong)用服(fu)(fu)务(wu)(wu)要全(quan)(quan)部(bu)入(ru)驻政(zheng)(zheng)务(wu)(wu)服(fu)(fu)务(wu)(wu)大厅,实(shi)施统(tong)一规范管(guan)理(li),为建(jian)设单位提(ti)供“一站(zhan)式”服(fu)(fu)务(wu)(wu)。
六、加强(qiang)组(zu)织实(shi)施(shi)
(十九)强化组织领导。住房城乡建设(she)部要(yao)切(qie)实(shi)担(dan)负(fu)起工程(cheng)建设(she)项(xiang)目审(shen)(shen)批制(zhi)度(du)(du)(du)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)工作(zuo)的组(zu)(zu)织协调和(he)督促指导(dao)责(ze)任(ren)(ren);各(ge)部门要(yao)密切(qie)协调配合,加强(qiang)工程(cheng)建设(she)项(xiang)目审(shen)(shen)批制(zhi)度(du)(du)(du)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)、投资审(shen)(shen)批制(zhi)度(du)(du)(du)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)等“放管服”各(ge)项(xiang)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)任(ren)(ren)务(wu)的协同联动(dong),形成(cheng)(cheng)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)合力。各(ge)省级人(ren)民(min)政(zheng)(zheng)府要(yao)按照本(ben)实(shi)施意(yi)见要(yao)求,全面领导(dao)本(ben)地区工程(cheng)建设(she)项(xiang)目审(shen)(shen)批制(zhi)度(du)(du)(du)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)工作(zuo),加强(qiang)统筹(chou)协调、指导(dao)和(he)督促,为改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)工作(zuo)提供(gong)组(zu)(zu)织和(he)经费保(bao)障,积极推动(dong)各(ge)项(xiang)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)措施落地。各(ge)省级人(ren)民(min)政(zheng)(zheng)府要(yao)在本(ben)实(shi)施意(yi)见印发后1个(ge)月内制(zhi)定具(ju)体(ti)实(shi)施方案,并报住房城乡建设(she)部备(bei)案。各(ge)地方人(ren)民(min)政(zheng)(zheng)府要(yao)高度(du)(du)(du)重视工程(cheng)建设(she)项(xiang)目审(shen)(shen)批制(zhi)度(du)(du)(du)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)工作(zuo),承担(dan)改(gai)(gai)(gai)(gai)(gai)革(ge)(ge)主体(ti)责(ze)任(ren)(ren),成(cheng)(cheng)立(li)以主要(yao)负(fu)责(ze)同志(zhi)为组(zu)(zu)长的领导(dao)小(xiao)组(zu)(zu),明确(que)责(ze)任(ren)(ren)部门,制(zhi)定时(shi)间表、路线图(tu),确(que)保(bao)按时(shi)保(bao)质完成(cheng)(cheng)任(ren)(ren)务(wu)。
(二十)加强沟通反馈和培训。住房城乡(xiang)建设(she)部要建立上(shang)下联(lian)动(dong)的(de)沟通(tong)反馈(kui)机(ji)制,及时了解(jie)(jie)地(di)(di)方(fang)工(gong)(gong)程建设(she)项目审批制度改革(ge)(ge)工(gong)(gong)作(zuo)情况,督促指导地(di)(di)方(fang)研(yan)究解(jie)(jie)决改革(ge)(ge)中遇到的(de)问(wen)题(ti)。各地(di)(di)要针对重点、难点问(wen)题(ti),采用(yong)集中培训、网络(luo)培训和(he)专题(ti)培训等方(fang)式,加强对各级领导干部、工(gong)(gong)作(zuo)人员和(he)申请(qing)人的(de)业(ye)务(wu)培训,对相关政(zheng)策进(jin)行全面解(jie)(jie)读和(he)辅(fu)导,提高改革(ge)(ge)能力和(he)业(ye)务(wu)水平。
(二十一)严格督促落实。住房城乡(xiang)建设部(bu)要会同(tong)相关(guan)(guan)部(bu)门建立工(gong)程(cheng)建设项目审批制度(du)改革(ge)评(ping)估评(ping)价机制,重点评(ping)估评(ping)价各(ge)地(di)全(quan)流(liu)程(cheng)、全(quan)覆盖(gai)改革(ge)和统(tong)(tong)一审批流(liu)程(cheng)、统(tong)(tong)一信(xin)息数据平(ping)台、统(tong)(tong)一审批管理体系(xi)、统(tong)(tong)一监管方(fang)式等情(qing)况(kuang),并将(jiang)有(you)关(guan)(guan)情(qing)况(kuang)报国务院。地(di)方(fang)各(ge)级人(ren)民(min)政府要加大对地(di)方(fang)有(you)关(guan)(guan)部(bu)门工(gong)作(zuo)(zuo)的督导力度(du),跟踪改革(ge)任务落实情(qing)况(kuang)。各(ge)省级人(ren)民(min)政府要定期向住房城乡(xiang)建设部(bu)报送工(gong)作(zuo)(zuo)进展情(qing)况(kuang)。对于工(gong)作(zuo)(zuo)推进不(bu)力、影响工(gong)程(cheng)建设项目审批制度(du)改革(ge)进程(cheng),特别是未按时完成阶段性工(gong)作(zuo)(zuo)目标的,要依法依规严肃问责。
(二十二)做好宣传引导。各地要通过多种形式及时宣传报道(dao)相(xiang)关工(gong)作措施和取得的(de)成效,加强舆(yu)论引导,增进(jin)社会公众(zhong)对工(gong)程(cheng)建设项(xiang)目(mu)审批制度改革工(gong)作的(de)了解和支持(chi),及时回应群众(zhong)关切,为顺利推进(jin)改革营(ying)造良好的(de)舆(yu)论环境。
